Manhattan District Attorney Alvin Bragg surprised many observers when he announced a first-degree murder charge against Luigi Mangione, the 26-year-old accused of assassinating a health insurance executive outside a New York City hotel. This comes as a surprise, as under New York law, second-degree murder is typically the normal charge for a premeditated slaying.

Prosectors allege that the shooting of UnitedHealthcare CEO Brian Thompson was an act of terror, but legal experts, including defense attorney Lara Yeretsian, have expressed skepticism, stating that the charge may be a stretch and could backfire on the prosecution.

The surprising charge of first-degree murder committed in furtherance of terrorism was met with criticism from Mangione’s defense lawyer, Karen Friedman Agnifilo, who argued that the theory of the murder charge in the Manhattan DA’s case seems to be in conflict with the theory being brought by the U.S. Attorney’s Office, which accused Mangione of stalking and potentially influencing a group of people.

The federal charges, which include murder, stalking, and federal firearms offenses, do not mention terrorism, leading experts to question whether the allegations are overcharged. Some, like defense attorney Linda Kenney Baden, believe that both the state-level terror case and the federal attempt to impose the death penalty are overcharging.

The family of Brian Thompson, the CEO of UnitedHealthcare, mourned the loss of their loved one, with the company’s parent CEO implored people to see that industry executives are trying their best with a flawed system. The assasination has also garnered widespread media attention, with some, like New York defense attorney Neama Rahmani, suggesting that Mangione is being treated differently because he killed a CEO rather than an “ordinary” victim.
